About these terms
These terms are an agreement between you and Tillermark LLC, a Delaware limited liability company (211 N Market St, Wilmington, DE 19801, United States), which runs Tillermark. By using this website or the Tillermark service, you accept them. If you use Tillermark for a company, you confirm you can accept these terms on its behalf.
Who can use Tillermark
Tillermark is a business service. You must be at least 18 years old and use it for professional purposes.
The service
We work to keep Tillermark available, secure and reliable. We improve the service continuously, and we’ll tell you in advance about any change that significantly reduces its features. Planned maintenance is scheduled to minimise disruption.
Fees
Pricing, billing terms and applicable fees for your plan are set out in your order form or agreement, and are agreed with you before your account is activated. You will never be moved onto a paid plan without agreeing to it. Published plans will show the full price, including any applicable sales tax, before you commit. See the refund policy.
Acceptable use
Don’t use Tillermark to break the law, infringe others’ rights, send spam, try to access data that isn’t yours, interfere with the service or reverse-engineer it, or connect data you don’t have permission to share.
Your data
You own the data you connect to Tillermark. You give us permission to process it only to provide the service to you. Our privacy policy explains how we handle personal data, and customers can sign a data-processing agreement with us. You can export or delete your workspace data at any time.
Intellectual property
Tillermark, its software, design and content belong to Tillermark LLC or its licensors. If you send us feedback, we may use it to improve Tillermark without obligation to you.
AI outputs and approvals
Tillermark’s explanations and suggestions are generated automatically and come with a confidence level and sources. They can be wrong. You stay responsible for the decisions you approve. Tillermark will not take actions in your tools unless someone you’ve authorised approves them.
Liability
Except as set out in your agreement with us, Tillermark is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, such as lost profit or lost data, and our total liability for any claim is limited to the greater of the fees you paid us in the 12 months before the claim and $100. Nothing in these terms limits liability that cannot be limited by law.
Ending the service
You can stop using Tillermark at any time. We may suspend accounts that break these terms. If we ever discontinue the service, we’ll give you at least 30 days’ notice and a way to export your data.
Law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. We’ll try to resolve any disagreement directly with you first. If we can’t, it will be decided by the state or federal courts located in New Castle County, Delaware, and both of us consent to their jurisdiction. If you are based outside the US, this doesn’t remove any protection that the mandatory law of your country gives you.
Changes to these terms
We may update these terms from time to time. When we make a material change, we’ll update the date above and give customers reasonable notice before it takes effect. Continuing to use Tillermark after that means you accept the updated terms.
General
These terms, together with any order form or agreement you sign with us, are the entire agreement between you and us about Tillermark. If any part is found unenforceable, the rest stays in effect. Our not enforcing a right is not a waiver of it. You may not transfer these terms without our consent; we may transfer them as part of a merger or acquisition.
